Welcome to Marina Furniture. In these Terms, "we," "us," and "our" refer to Marina Furniture. We operate our online store, website, and all related content, features, tools, products, and services — together, the "Services" — to bring you a straightforward furniture shopping experience. Our store is powered by Shopify, which provides the platform infrastructure behind the Services.
These Terms of Service ("Terms"), together with the policies referenced within, set out your rights and responsibilities when using the Services. They include important information about your legal rights, including warranty disclaimers and limitations of liability. Please read them carefully.
By visiting, browsing, or purchasing through any of our Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, please discontinue use of our Services.
Section 1 — Eligibility & Account Responsibility
By using the Services, you confirm that you have reached the age of majority in your state of residence, and that any minor dependents under your supervision use the Services only on devices you control.
When creating an account or placing an order, you agree to provide information that is truthful, accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activity under your account. You may not transfer, sell, share, or license your account to anyone else.
Section 2 — Product Descriptions & Availability
We make reasonable efforts to present our products accurately. However, colors, textures, dimensions, fabric patterns, and wood grain may vary slightly from what appears on your screen due to display settings and device differences. We do not guarantee that any product will perfectly match its on-screen depiction.
Product descriptions, specifications, and pricing are subject to change without prior notice. We may discontinue any product and may limit quantities available to any customer or region.
Section 3 — Orders, Cancellation & Returns
When you submit an order, you are making an offer to purchase. We may accept or decline any order; your order is accepted once we send an order confirmation and payment is successfully processed.
24-Hour Cancellation — You may cancel any order free of charge within 24 hours of placing it, provided it has not yet entered fulfillment or shipping. Contact us with your order number to request cancellation. Once an order has shipped, it can no longer be cancelled — but you remain covered by our 30-day return program.
Returns & Exchanges — All purchases are governed by our published Return & Cancellation Policy, which includes 30-day free returns and exchanges on eligible items.
You confirm that purchases through the Services are for your own personal or household use, not for commercial resale or export.
Section 4 — Pricing, Taxes & Payment
Prices, promotions, and offers may change without notice. The price charged is the price shown at the time you place your order, as confirmed in your order confirmation email. Listed prices exclude applicable sales tax, which is calculated at checkout based on your shipping address. In the event of a pricing error, our Payment Policy governs — including our right to cancel the affected order and issue a full refund.
Unless stated otherwise on a product page or at checkout, prices do not include taxes. Standard shipping is free to eligible addresses in the 48 contiguous U.S. states and Washington, D.C. — see our Shipping Policy for details and restrictions.
Prices online may differ from prices at physical retail locations or other platforms. Promotional offers are governed by their own terms, which may supersede these Terms in the event of a conflict.
You agree to provide current, accurate payment information for every transaction and represent that: (i) your payment information is true, correct, and complete; (ii) you are authorized to use the designated payment method; (iii) your financial institution will honor the charges; and (iv) you will pay all posted prices plus applicable taxes.
Section 5 — Processing, Shipping & Delivery
- Orders are processed and prepared for shipment within 1–3 business days of purchase. Orders placed before 3:00 PM Central Time (CT) on a business day typically begin processing the same day; later orders begin the next business day. Processing excludes weekends and public holidays.
- Once shipped, orders generally arrive within 4–7 business days, depending on destination and carrier transit times.
- Standard shipping is free with no minimum purchase to eligible U.S. addresses, subject to the restrictions in our Shipping Policy.
We are not responsible for delivery delays caused by carriers, weather, natural disasters, or other circumstances beyond our reasonable control. Title and risk of loss transfer upon handoff to the carrier; this does not affect your rights regarding items damaged or lost in transit, which are covered under our Shipping Policy and Return & Cancellation Policy.
Section 6 — Intellectual Property
All content available through the Services — including trademarks, text, images, graphics, photos, videos, software, site design, and the selection and arrangement of elements — is the property of Marina Furniture, its affiliates, or its licensors, and is protected by U.S. and international intellectual property laws.
These Terms grant you a limited, revocable, non-exclusive license to use the Services for personal, non-commercial shopping purposes only. You may not reproduce, distribute, modify, create derivative works from, republish, or exploit any material from our Services without our prior written consent.
The names "Marina Furniture," our logos, product names, and design elements are trademarks of Marina Furniture. Other trademarks appearing on the Services belong to their respective owners. All rights not expressly granted are reserved.
Section 7 — Third-Party Tools
The Services may provide access to tools or features developed and maintained by third parties. We do not control these tools and provide them on an "as is" and "as available" basis without warranties of any kind. Your use of third-party tools is at your own risk, and we recommend reviewing the terms of the relevant third-party providers. Our website may contain links to external sites operated by third parties. We do not review or verify third-party content and are not responsible for any harm, loss, or damage arising from your use of external sites or transactions with third parties. Section 9 — Platform (Shopify)
Our store is hosted on and powered by Shopify, which provides the technology enabling the Services. However, every sale conducted through our store is a transaction directly between you and Marina Furniture — not with Shopify. Shopify is not responsible for product, delivery, or service matters arising from your purchases with us.
Section 10 — Privacy
Personal information is handled in accordance with our Privacy Policy. Because our platform is hosted by Shopify, certain information about your use of the Services may be processed by Shopify and its service providers, including in countries outside your own, for the purpose of providing the platform.
Section 11 — User Feedback & Submissions
If you submit reviews, comments, suggestions, or other content ("Feedback"), you grant Marina Furniture a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that Feedback in connection with our business. You represent that you own or have the necessary rights to your Feedback, and that it is truthful, lawful, and does not infringe the rights of others or contain harmful code.
We may, but are not obligated to, monitor or remove Feedback that we determine to be unlawful, abusive, defamatory, or otherwise objectionable. You are responsible for the accuracy and content of any Feedback you submit.

We may correct such errors, update information, or cancel affected orders at any time — including after an order is submitted — with notification and a full refund where applicable, as described in our Payment Policy.

We may restrict or terminate access to the Services at our discretion. Sections intended to survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Privacy — remain in effect afterward.

Information on the Services is provided for general informational purposes; any reliance on it is at your own risk. Except as expressly stated by Marina Furniture, the Services and products are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied — including implied warranties of merchantability, fitness for a particular purpose, and title. We do not warrant that the Services will be uninterrupted, error-free, or secure. Nothing in these Terms limits any rights you may have under applicable consumer protection laws.
Section 16 — Limitation of Liability
To the maximum extent permitted by applicable law, Marina Furniture shall not be liable for any indirect, incidental, punitive, special, or consequential damages — including lost profits, lost revenue, or loss of data — arising from your use of the Services or any products obtained through them. Our total liability for any claim related to an order shall not exceed the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law.
Section 17 — Indemnification
You agree to indemnify and hold harmless Marina Furniture and our affiliates, officers, employees, and service providers from claims arising out of your breach of these Terms, your violation of applicable law or third-party rights, or your misuse of the Services.
Section 18 — Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Section 19 — Waiver & Entire Agreement
Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with our posted policies, constitute the entire agreement between you and Marina Furniture regarding the Services and supersede all prior agreements on the same subject.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a business reorganization, merger, or sale of assets.
Section 21 — Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. You and Marina Furniture consent to the exclusive jurisdiction of the state and federal courts located in Collin County, Texas for any disputes arising under or related to these Terms.
Section 22 — Amendments
We may update these Terms at any time by publishing the revised version on this page, with the "Last Updated" date reflecting the latest revision. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
